  1. Why Am I receiving This Notice?

    A court has authorized this Notice concerning a change in class action status in the above-mentioned lawsuit (the “Lawsuit”) involving the marketing of cruise vacation packages and services by Royal Seas Cruises, Inc. (“Royal Seas”) through an automatic telephone dialing system and/or artificial or prerecorded voice. On December 21, 2023, the Court decertified the class finding that a class action is no longer superior to other available methods for fairly and efficiently adjudicating this controversy, due to a demonstration made by Defendant of its insolvency and a complete lack of funds available to compensate the Class for any settlement or judgment. The Court made this determination on its own Motion after reviewing the evidence from Defendant, and after the attorneys for both sides stated that they did not oppose decertification of the class. You are receiving this Notice because the change in class action status may impact your rights.

  2. Was I A Class Member?

    You were a “Class Member” if you received a call on your cell phone from Prospects, DM, Inc. on behalf of Royal Seas Cruises, Inc. that was made using an automatic telephone dialing system or prerecorded voice between November 2016 and December 2017 (“Class Period”). Specifically, the proposed settlement includes all persons in the U.S. who received a telephone call: (1) from Prospects, DM, Inc. on behalf of Royal Seas Cruises, Inc. (2) on said Class Member’s cellular telephone (3) made through the use of any automatic telephone dialing system or an artificial or prerecorded voice, (4) between November 2016 and December 2017, (5) where such calls were placed for the purpose of marketing, (6) to non-customers of Royal Seas Cruises, Inc. at the time of the calls, (7) whose cellular telephone number is associated in Prospects, DM, Inc’s. records with either diabeteshealth.info or www.yourautohealthlifeinsurance.com, and (8) whose call resulted in a Transfer to Royal Seas Cruises, Inc.

  3. How Does This Impact Me?

    Since the Class was decertified, and no class action settlement was approved by the Court, any individual claims you may have against Royal Seas that were alleged in the Lawsuit have not been released.

  4. What If I Still Want to Pursue My Claims?

    Should you wish to pursue any legal claims you may have against Royal Seas  SeasCruises, Inc. relating to the receipt of one or more calls on your cell phone from Prospects, DM, Inc. on behalf of Royal Seas Cruises,Inc. via an automatic telephone dialing system or prerecorded during the Class Period, you should seek legal advice immediately as thelaw generally provides a limited amount of time to assert your rights.  Class Counsel would recommend taking action within 60 days.
